Article 1 – Seller identification
This online sales site is operated by:
Star à Pattes SRL
Registered office: Chaussée de Wavre 1617, 1160 Auderghem, Belgium
Company / VAT No.: BE 0886.795.576
Email: info@lanimalrit.be
Hereinafter referred to as "the Seller".
These General Terms and Conditions of Sale, hereinafter "GTCS", govern product sales made by Star à Pattes SRL to consumers through its online store.
Article 2 – Scope of application and acceptance
These GTCS apply to all orders placed on the online store operated by Star à Pattes SRL.
The Customer acknowledges having read these GTCS before placing their order and accepts them without reservation.
Validation of the order implies acceptance of the GTCS applicable at that time.
These GTCS are accessible at all times on the site.
Article 3 – Products
Star à Pattes SRL offers for sale food, treats, accessories, toys, care products, and other items primarily intended for dogs and cats.
The essential characteristics of the products are presented on the product sheets.
Photographs and illustrations are presented with the utmost care. Slight differences in color, apparent dimensions, or presentation may result from the screen used, the lighting of the photographs, or a change in presentation made by the manufacturer.
These differences do not infringe upon the Customer's rights when they relate to an essential characteristic of the product or constitute a lack of conformity.
Product offers are valid while stocks last.
In the event of an exceptional unavailability of a product after the order is validated, the Customer will be informed as soon as possible. The unavailable product will be refunded if no replacement is accepted by the Customer.
Article 4 – Price
Prices displayed on the site are indicated in euros (€), inclusive of all taxes (VAT), unless otherwise stated.
Delivery costs are not necessarily included in the product price. Where applicable, they are indicated to the Customer before final validation of their order.
Star à Pattes SRL reserves the right to modify its prices at any time. However, products are billed at the price displayed at the time of order validation, subject to a manifest price error.
Any promotions are valid during the indicated period and while stocks last.
Article 5 – Order
The Customer selects the products they wish to purchase and adds them to their cart.
Before definitively confirming the order, the Customer has the opportunity to check its contents, total price, any additional costs, and to correct any errors.
The Customer must provide accurate and complete information necessary for the processing and delivery of their order.
The order becomes definitive when the Customer validates it with an obligation to pay and payment is accepted, subject to legal provisions regarding the right of withdrawal.
An order confirmation is sent to the Customer electronically.
Star à Pattes SRL reserves the right to refuse or cancel an order in cases authorized by legislation, particularly in the event of proven fraud, impossibility of execution, or a previous dispute relating to the payment of an order, provided that this refusal is objectively justified.
Article 6 – Payment
The payment methods effectively available are those offered to the Customer when placing their order on the site.
Payment is made using the secure payment systems offered by the online store.
Star à Pattes SRL does not have access to the Customer's confidential banking data when this is processed directly by the payment provider.
The order may be suspended or canceled if payment is refused by the payment institution.
Article 7 – Delivery
Products are delivered to the address or collection point indicated by the Customer when ordering, from among the delivery methods offered by the store.
The available delivery areas and corresponding costs are indicated to the Customer before order validation.
The delivery time or period applicable is communicated to the Customer during the ordering process.
Failing any other agreed time frame, delivery will take place at the latest within 30 days of the conclusion of the contract, in accordance with applicable law.
The Customer is responsible for the accuracy of the information they provide to enable delivery.
In the event of delay or default of delivery, the Customer benefits from the rights provided by applicable Belgian law.
Star à Pattes SRL remains responsible to the consumer for the proper execution of the delivery in accordance with legal provisions and cannot simply refer the Customer to the carrier in the event of a non-received package. The FPS Economy specifically draws the attention of online merchants to this obligation.
Article 8 – Receipt of the order
The Customer is invited to check the condition and content of their order upon receipt.
In the event of a damaged, incorrect, or missing product, the Customer is invited to contact Star à Pattes SRL as soon as possible at the address info@lanimalrit.be, indicating their order number and, where useful, attaching photographs showing the problem.
This invitation to provide prompt notice does not deprive the Customer of their rights under applicable legislation, particularly regarding the legal warranty.
Article 9 – Right of withdrawal
In accordance with the Belgian Code of Economic Law, the consumer generally has a period of 14 calendar days to withdraw from a remote purchase, without having to justify their decision.
For contracts for the sale of goods, this period begins in principle on the day the Customer, or a third party other than the carrier and designated by them, physically takes possession of the good.
In the event of an order for several goods delivered separately, the legal rules regarding the starting point of the withdrawal period apply.
To exercise their right of withdrawal, the Customer must communicate their decision to withdraw by means of an unambiguous statement to:
Star à Pattes SRL
Chaussée de Wavre 1617
1160 Auderghem
Belgium
Email: info@lanimalrit.be
The Customer may also use the model withdrawal form provided at the end of these GTCS, although its use is not mandatory.
Article 10 – Return after withdrawal
After communicating their decision to withdraw, the Customer must return or send back the products within the applicable legal period, and no later than 14 days after communicating their decision to withdraw.
Unless otherwise indicated by Star à Pattes SRL, the direct costs of return are borne by the Customer. This information must be communicated to the consumer before the conclusion of the contract.
The Customer must handle the product only to the extent necessary to establish its nature, characteristics, and proper functioning.
They may be held liable for any depreciation of the product resulting from handling beyond what is necessary for this verification.
The product must be properly packaged to avoid any damage during transport.
Article 11 – Exceptions to the right of withdrawal
The right of withdrawal does not apply in cases where it is excluded by law.
This may in particular concern, depending on the products marketed:
goods made to the Customer's specifications or clearly personalized;goods liable to deteriorate or expire rapidly;sealed goods which cannot be returned for health protection or hygiene reasons and were unsealed by the Customer after delivery;other products or situations for which the legislation expressly excludes the right of withdrawal.
When a product sold on the site does not legally benefit from the right of withdrawal, this information is communicated to the Customer before the contract is concluded.
Article 12 – Refund in case of withdrawal
In the event of a valid withdrawal, Star à Pattes SRL shall refund payments received from the Customer in accordance with legal provisions, including, where required by law, standard delivery costs corresponding to the least expensive delivery method offered.
Any additional costs resulting from the Customer's express choice of a more expensive delivery method than the standard method offered do not need to be refunded to the extent permitted by legislation.
The refund shall be made within the applicable legal timeframe.
Star à Pattes SRL may defer the refund in cases provided for by law, in particular until the goods are recovered or until the Customer provides proof of their shipment, whichever occurs first.
The refund is generally made using the same payment method used for the initial transaction, unless the Customer has expressly agreed to another method and provided that this does not incur any costs for the Customer.
Article 13 – Legal guarantee of conformity
All products sold to consumers benefit from the applicable legal guarantee of conformity.
For new consumer goods, the legal guarantee is in principle two years from delivery of the good. The seller may not reduce the rights granted to the consumer by this guarantee.
In the event of a lack of conformity, the Customer shall benefit from the remedies provided for by Belgian legislation, according to the applicable legal conditions.
The Customer is invited to inform Star à Pattes SRL of the defect as soon as possible and, in any event, within the applicable legal timeframe.
To submit a claim under the guarantee, the Customer may contact:
info@lanimalrit.be
by indicating their order number and providing information allowing the identification of the product and the reported defect.
This provision does not in any way limit the consumer's legal rights.
Article 14 – Use of products
The Customer must respect the instructions, precautions, warnings, sizes, recommendations, and conditions of use provided with the product or by its manufacturer.
For products intended for animals, the Customer must in particular choose a product adapted to the species, size, weight, and, where relevant, age of the animal.
Toys and accessories intended for animals must be used in accordance with their intended purpose and under appropriate supervision when recommended.
No provision of these Terms and Conditions of Sale shall limit the liability of Star à Pattes SRL when it cannot be legally excluded or limited.
Article 15 – Liability
Star à Pattes SRL is responsible for the performance of its obligations in accordance with applicable legislation.
However, it cannot be held liable for non-performance resulting from an event of force majeure recognized as such by applicable law.
No provision of these Terms and Conditions of Sale is intended to have the effect of excluding or limiting the mandatory rights granted to the consumer by Belgian legislation.
Article 16 – Personal data
Personal data provided by the Customer is processed in accordance with applicable data protection legislation, in particular the General Data Protection Regulation (GDPR).
Detailed information regarding the data collected, the purposes of processing, retention periods, any potential recipients, and the Customer's rights can be found in the Privacy Policy available on the site.
Article 17 – Intellectual property
Texts, graphic elements, logos, photographs, illustrations, and other content created for the site and belonging to Star à Pattes SRL are protected by applicable intellectual property rights.
Any unauthorized reproduction, representation, or use of these elements is prohibited within the limits provided by legislation.
Trademarks, photographs, and other content belonging to manufacturers, suppliers, or other third parties remain the property of their respective owners.
Article 18 – Complaints
For any question or complaint regarding an order, the Customer may contact:
Star à Pattes SRL
Chaussée de Wavre 1617
1160 Auderghem – Belgium
E-mail: info@lanimalrit.be
Star à Pattes SRL will strive to seek an amicable solution as quickly as possible.
Article 19 – Governing law and disputes
These General Terms and Conditions of Sale are governed by Belgian law, without prejudice to mandatory protective provisions from which a consumer might benefit under applicable legislation.
In the event of a dispute, the Customer is invited to contact Star à Pattes SRL beforehand to seek an amicable solution.
Failing an amicable solution, the competent courts shall be determined in accordance with applicable legal rules.
No provision of these Terms and Conditions of Sale deprives the consumer of the right to refer the matter to the competent court recognized to them by applicable legislation.
